Updated September 21, 2026: The Digital Asset Market Clarity Act (H.R. 3633) passed the U.S. House in July 2025. A revised Senate version advanced through committee in 2026, but on September 15 the Senate failed to advance the bill in a procedural vote. The legislation therefore has not become law.
What is the CLARITY Act trying to do?
The legislation seeks to define a federal market structure for digital assets and clarify regulatory responsibilities involving the SEC and CFTC, including rules around digital commodities and intermediaries.
What happened in September 2026?
The Senate vote did not reach the threshold required to advance the measure. Procedural options may allow lawmakers to revisit it, so “stalled” is more accurate than treating the proposal as permanently dead.
Does the bill mean Cardano “wins”?
No. The old article made that conclusion and compared networks as though Congress had selected a technical winner. The legislation sets regulatory criteria; how any particular asset or network would be treated depends on statutory definitions, facts and subsequent regulatory interpretation.
Why does decentralization still matter?
Network structure can be relevant to legal analysis, but decentralization is multidimensional. Validator distribution, governance, token ownership, development control and intermediary roles cannot be reduced to a slogan or a single score.
